Media

This type of service allows User Data to be utilized for advertising communication purposes displayed in the form of banners and other advertisements on this Application, possibly based on User interests.

The Data Controller reserves the right to make changes to this privacy policy at any time by giving notice to its Users on this page. Express yourself, but always respect other members of the community
Shortfundly is a place where different cultures of filmmakers & movie-buff audience, beliefs and ideas come together. We want people to feel safe on the platform while enjoying the freedom of expressing their unique point of view.

We embrace diverse voices, but we draw the line at content that does not respect others’ opinions or violate others’ rights.

Abusive behavior and content: In order to promote healthy and open communication on Shortfundly, we prohibit behavior and content that aggressively insult, harass, intimidate or bully others. Content with the intention to defame someone is also not allowed.

Hate speech: We also do not allow posts or any content that incites hatred against an individual or a group of people based on their race, ethnicity, religion, caste, culture, nationality, disability, sexual orientation, gender, gender identity, age, or any other discrimination.

Spam: Users come to Shortfundly for high-quality and engaging content of shortfilm videos, posters, teasers, etc.,. Help us foster a meaningful and genuine community by not posting spammy content or creating artificial traffic, such as trading comments and using deceptive information to encourage views or likes.

Impersonation and fake content: You may not create inauthentic accounts with the intention to confuse others, and don’t spread fake news or other fake content.

Intellectual property infringement: You own all the information and content you post on Shortfundly. However, please respect others’ copyrights, trademarks, and other legal rights, and don’t post anything that you do not hold the rights for.

Violation of privacy: Remember to respect other people’s privacy, and don’t disclose others’ personally identifiable information, such as an address, phone number, email address, ID number, and credit card number.

Remember to keep your interactions civil, and always treat all users with respect.


Post and share content that resonates with a diverse audience
While we want people to feel free to share content about their opinions and stories, we don’t allow content that could harm other users or encourage them to harm themselves – whether through physical, emotional, financial, or legal harm.

We consider the following content inappropriate and harmful to our users and our platform:

Terrorism and extremism: Shortfundly has a zero-tolerance policy for accounts belonging to terrorist groups or individuals. We also prohibit the use of the Shortfundly platform by extremist groups or individuals, who use violence to advance their political, religious or social cause. Posts promoting and supporting these organizations or individuals breach our guidelines.

Violent and graphic content: Shortfundly does not allow content or behavior that encourages or incites violence against an individual or group of people. This includes, but is not limited to, graphic or bloody scenes, threats of physical harm or death, rape and sexual assault, and content that could cause public violence in real life.

Glorification of self-harm and suicide: The Shortfundly community cares for each other, and is often a place where people come together to get through hard times. In order to maintain this supportive environment, we will remove the content encouraging or promoting self-harm and suicidal behavior.

Pornography and nudity: Shortfundly is not the place for sexually explicit content or content intended for sexual gratification. Please don’t post the content if it isn’t something suitable to be done or shown to your parents or children.

Child sexual exploitation: Shortfundly upholds the protection of minors (under the age of 13). If we are made aware of content that sexually exploits, targets, or endangers children, we may comply with law enforcement or report cases, as appropriate.

Some other examples of behavior or content that would fall under this policy include:

  • glorifying the use of weapons, bombs, drugs, or any other goods regulated by local laws
  • online gambling or other fraudulent financial schemes
  • engaging in illegal activities or inciting others to such activities

We don’t tolerate any form of malicious activity
We strive to protect Shortfundly users from malicious activities and keep Shortfundly secure. You may not do, or attempt to do, any of the following while accessing or using Shortfundly:

  • Interfere with Shortfundly’s daily operation, hack its website or associated networks, or bypass its measures to restrict users’ access.
  • Distribute files that contain viruses, trojans, worms, logic bombs, or other material that is malicious or technologically harmful.
  • Modify, adapt, translate, reverse engineer, disassemble, decompile, or create any derivative products based on Shortfundly, including any files, tables, or documentation, nor attempt to regenerate any source code, algorithms, methods, or techniques embodied in Shortfundly.
  • Use automated scripts to collect information from Shortfundly.

Upholding our Community Guidelines

All Shortfundly users must follow the policies set forth in the Shortfundly Community Guidelines. If a behavior violates these guidelines, or if we receive a valid and properly scoped request from law enforcement bodies or other authorized entities, we investigate the case and take proper action. Depending on the severity of the violation and a user’s history on Shortfundly, we may take one or more of the following enforcement measures.

Limiting visibility: We may reduce the distribution of the content that may not be appropriate for all audiences. This makes content less visible on the Popular page or only visible to your followers.

Removing content: We may remove your content from our platform if the content violates the Guidelines and is harmful to the whole community, such as death threats, hate speech, video playback issues, suicidal behavior, or child abuse. We will also remove the content if we receive a valid and properly scoped request from law enforcement bodies or other authorized entities.

Suspending an account: This is our most severe enforcement action. When an account is suspended, it is removed from the platform and the violator will not be allowed to create new accounts.

Reporting to law enforcement bodies: When we believe there is a genuine risk of physical harm or direct threats to public safety, we will report the case to law enforcement bodies as permitted by local laws.

Law Enforcement Guidelines
These operational guidelines are a reference for law enforcement officials seeking information from us about user activity on Shortfundly. We may change these guidelines at any time, without notice.

General
We disclose Shortfundly accounts information solely in accordance with our terms of service and applicable law, upon request from law enforcement officials with lawful documents.

Account Information Availability
When creating an account in Shortfundly, user may: provide profile information; post text, picture or other material; communicate with another user; or conduct other activities. We retain different types of information for different time periods. We cannot guarantee retention and accuracy of any data we stored. Upon request with due legal process, we will search for and disclose data which we are reasonably to locate and retrieve.

Request for Account Information
Any non-public information of the user will only be released to law enforcement in response to legal process such as a subpoena, court order, or other valid legal process.

Any private message of user requires a valid search warrant or any equivalent order.

Details for Request
Requests for user account information in accordance with applicable law, are required to include the following information:

  • username of the relevant account
  • specific information requested

Note that we are unable to process overly broad or vague requests.

The request shall be signed by the head of that law enforcement agency and sent via a valid official government email address.

Preservation Requests
We will honor formal requests from law enforcement to preserve user data. Upon receiving the due request, we will attempt to preserve available account information associated with any properly identified user for up to 90 days.

Preservation requests, in accordance with applicable law, should:

  • be signed by the requesting official on law enforcement letterhead
  • have a valid government official email address;
  • provide the relevant username

Emergency Request
An emergency request may be submitted through email at [email protected].

We evaluate emergency requests on a case-by-case basis. In certain situations, we are able to voluntarily disclose personal data about an individual without the consent of the individual where such disclosure is necessary to respond to an emergency that threatens the life, health or safety of the individual or another individual.

All emergency requests must be in writing on official letterhead, signed by a sworn law enforcement official, and come from a valid government official email address.

Non-law enforcement personnel aware of an emergency should immediately and directly contact local law enforcement officials.

Content Removal Request
If you are a law enforcement or government official and find out potentially illegal content in Shortfundly, you can first review our Term of Service, Community Guidelines and other published policies first, and submit potential violation of the relevant case by using our “Report” function in-app. Our dedicated team will process your submission expeditiously. If you receive a response from us that the reported case does not currently violate our policies, you can submit, via an official government or law enforcement email address, a request to remove content, in which you shall identify the local laws the reported case is deemed to have violated and court order or other supportive documentation. We will process your request as soon as possible.

Notification to users
It is our policy to notify our users when we receive legal process seeking their records, information or content or removing the same unless providing such notice is prohibited under law.

Further, if your request places us on notice of an ongoing or prior violation of our terms, we will take action to prevent further abuse, including account termination and other actions that may notify the user that we are aware of their misconduct. If you believe in good faith that taking such actions will jeopardize your ongoing investigation, you may request that we defer such action in your request and we will take your request under advisement. It is the responsibility of the requesting law enforcement official to make this request, as it is our policy to enforce its terms.

We reserve the right to seek reimbursement for the costs associated with responding to law enforcement data requests.
